Michael Siekman
It has long been the assumption that because patent interferences (two or more pending patent applications) are so uncommon, most patent lawyers don’t handle a single interference case in their entire career. Yet for Michael Siekman, a Shareholder at Wolf Greenfield, a leading Boston intellectual property law firm, handling interference cases is an ongoing occupation.
“Few patent attorneys are comfortable with interferences…and few recognize their potential,” Siekman has written. “(Yet) since 1984, the US Patent and Trademark Office has determined patentability issues in interferences. This provides a potential avenue for challenging the validity of an issued patent—one that is highly favorable to a patent challenger.” After 15 years of serving as counsel in patent interferences in the biotech, pharmaceutical, electrical, and consumer product fields, Michael has perfected the art of provoking or avoiding an interference during prosecution.
A leader by nature, Michael understands the importance of sharing his specialized knowledge with others which he does by publishing articles. His articles can be found in such journals as Intellectual Property Today, Boston Business Journal, Mass High Tech, Patent Trademark & Copyright Journal, New England In-House Counsel, IndUS Business Journal and Inside Counsel. A member of the bar in both Massachusetts and District of Columbia, Michael is registered to practice before the U.S. Court of Appeals for the Federal Circuit and the U.S. Patent and Trademark Office. He is also a member of the Interference Committees of the Boston Patent Law American Intellectual Property Law and Intellectual Property Owners Associations. Recently, he was named one of the Massachusetts Super Lawyers’ “Rising Stars” in the field of intellectual property.
In addition to his specialization in interference, Michael also serves as a member of the Biotechnology, Pharmaceutical, and Litigation Practice Groups at Wolf Greenfield where he commonly assists clients in the biotechnology and pharmaceutical industries with various intellectual property matters. His proficiency includes overseeing the prosecution of patent applications dealing with recombinant vaccines, protein expression, antibodies, gene therapy, as well as numerous traditional pharmaceutical technologies. Michael has also coordinated the worldwide prosecution of patent applications, including European opposition proceedings, and is experienced in maximizing market exclusivity for clients via the interaction of both patent law and food and drug law under the Hatch-Waxman Act.
